Terms of Service

Article 1 (Purpose)

These terms and conditions aim to stipulate the rights, obligations, and responsibilities between the company and users regarding the use of Calmnest (hereinafter referred to as "Service").

Article 2 (Definitions)

• "Service" means the sleep induction and sleep pattern analysis service provided by Calmnest.
• "User" means a person who receives the service provided by the company in accordance with these terms and conditions.
• "Content" means digital content such as breathing guides and background sounds provided in the service.

Article 3 (Effect and Amendment of Terms and Conditions)

1. These terms and conditions take effect by being posted within the service or notified to users by other methods.

2. The company may amend these terms and conditions when deemed necessary, and the amended terms take effect by being announced in the same manner as paragraph 1.

Article 4 (Provision of Service)

The company provides the following services:

• Breathing-based sleep induction sessions
• Sleep pattern analysis and statistics provision
• Customizable sleep environment settings
• Sleep notification service
• Other services determined by the company

Article 5 (Service Hours)

The service is provided 24 hours a day, 365 days a year in principle. However, the service may be temporarily suspended for business or technical reasons of the company, and the service may be temporarily suspended during periods set by the company for operational purposes.

Article 6 (User Obligations)

Users shall not engage in the following acts:

• Registering false information when applying for or changing service use
• Misappropriation of others' information
• Altering information posted by the company
• Transmitting or posting information other than that designated by the company (such as computer programs)
• Infringement of intellectual property rights such as copyrights of the company and other third parties
• Acts that may interfere with the stable operation of the service

Article 7 (Service Suspension)

The company may suspend service provision in the following cases:

• Unavoidable circumstances due to facility maintenance, etc.
• When a telecommunications business operator as defined in the Telecommunications Business Act has suspended telecommunications services
• Other force majeure circumstances

Article 8 (Disclaimer and Compensation for Damages)

1. The company is exempted from responsibility for providing services if it is unable to provide services due to natural disasters, war, and other force majeure equivalent thereto.

2. This service is a sleep aid tool and is not a medical device, and is not intended for the diagnosis or treatment of sleep disorders. If you have sleep problems, please consult with a specialist.

Article 9 (Governing Law and Jurisdiction)

1. The laws of the Republic of Korea shall apply to the interpretation of these terms and conditions and disputes between the company and users.

2. In case a lawsuit is filed for a dispute arising from service use, the court having jurisdiction over the location of the company's head office shall be the competent court.
